JCR Privacy Policy

TheJCR.com is a website created in conjunction with The Journal of Court Reporting and The JCR Weekly presents the news of the day about court reporting, captioning, and legal videography. TheJCR.com, The JCR Weekly, and The Journal of Court Reporting are publications of the National Court Reporters Association (NCRA).

The National Court Reporters Association (referred to as “NCRA,” “Association,” “we,” “us,” and “our”) respects individual privacy and values the confidence of our members, potential members, program participants, sponsors, donors, industry partners, and our community. This Privacy Policy sets out the privacy principles that we follow with respect to the collection, use, and disclosure of information that you may provide through the NCRA.org website, TheJCR.com  website (our “website”), at our events you may attend, and through other submission channels where you submit information to NCRA.

Please read this entire Privacy Policy before using our website or submitting information to us. Following is a brief explanation of how we currently gather information about visitors and what is done with it.

NCRA’s mission and legitimate interests

NCRA’s mission is to promote excellence among those who capture and convert the spoken word to text and is committed to supporting every member in achieving the highest level of professional expertise. NCRA is committed to supporting its more than 12,000 members in achieving the highest level of professional expertise with educational opportunities and industry-recognized court reporting, captioning, education, and videography certification programs. As such, any information we collect serves to further our mission, including but not limited to the following:

  • Provide relevant information to our potential members, active members, program participants, and the public
  • Respond to inquiries relating to NCRA
  • Promote NCRA events, programs, and activities
  • Perform our contractual obligations with members in good standing, registered attendees at our events, candidates of our certification programs, customers on our online stores, and subscribers of our publications and other products/services
  • Meet our obligations to our advertisers and sponsors in NCRA’s print and digital publications and technology platforms
  • Administer and manage our certification programs
  • Administer donations to NCRA

Information we collect about you

Depending on what transactions you perform, we gather information that you agree to provide us, such as your email address, name, mailing address, telephone number, and credit card information. We may verify or combine this information with data about you that we have gathered from other sources, including a membership application, member directory update form, conference or seminar registration forms, etc. The legal justification for matching the data we collect with other data that we hold about you if you have used our services before is that we have a legitimate business interest for your personal data to be used for this specific purpose.

We are Payment Card Industry Data Security Standard (PCI DSS) compliant, and credit card numbers are stored, processed, and transmitted securely according to that standard.

When logged in to our website as a known contact, we store the following personal information in cookies (see below):

  • Contact Number
  • Name
  • Membership Status

We additionally collect information about how you use our website and the device(s) that you use to access the service. This includes collecting unique online identifiers such as IP addresses, which are numbers that uniquely identify a specific computer or other network device on the internet. We use the foregoing information in the form of summary statistics to help us make our website more useful to our visitors, such as assessing what information is of most and least interest.

How we use what we learn

We use the information you provide to us to carry out NCRA’s mission and relevant programs and activities, to fulfill our contractual obligations, and for performing marketing studies and development research so that we may keep you apprised of upcoming events and other offerings that we believe may be of interest to you. Also, we may use the information to help us create new offerings.

No collection of special data

We do not generally seek to collect any special categories of personal data such as personal data revealing racial or ethnic origin, political opinions, religious beliefs, genetic data, etc., nor do we collect any information about criminal convictions and offenses. In the limited cases where we do seek to collect such data, e.g., for purposes of complying with employment- related anti-discrimination laws, we will obtain express written consent from you.

How we share and disclose information

From time to time we are approached by third parties interested in identifying people who visit our site or who are members of NCRA. They may have a product to offer that would interest our visitors or members, or they may be collecting information for research or for some other legitimate purpose. It is our policy to furnish names, postal addresses, and email addresses in instances when we reasonably believe that the information to be conveyed by third parties will be of interest to a significant number of the people who receive it. Third parties with whom we have a contractual relationship under the Member Advantage Program may also request to receive members’ telephone numbers. We honor any opt-out/unsubscribe requests made by recipients where that information is communicated to us. Where possible, all commercial messages sent from NCRA and authorized third parties with whom we have a contractual relationship are requested to implement opt-out/unsubscribe mechanisms and honor any opt-out/unsubscribe requests by recipients.

Of course, your email address can be captured from your communications on the Web. And it is a relatively easy process for third parties to build lists of email addresses and other contact information from printed directories, online message forums, and other sources, even though doing so may violate usage rules set up by the directory publishers and forum operators. As a result, you may receive an email, mailing, or fax that appears to be officially sanctioned by NCRA when that is not the case. NCRA seeds its lists with dummy information as a way to detect unauthorized use, and we pursue your Association’s ownership rights with parties that violate the terms and conditions of list usage. If you have a question about the source or origin of a communication, please forward it to the NCRA Web Administrator.

When you terminate your membership or cancel the website account access, NCRA may continue to share information about you according to our legal and regulatory requirements.

NCRA may disclose your personal information as required by law or as needed in legal proceedings when NCRA believes in good faith that disclosure is necessary to protect NCRA’s  rights, protect your safety or the safety of others, investigate fraud, or respond to a legal or government request.

In addition, in the event of a merger, acquisition, or any form of sale or transfer of some or all of our assets to a third party, we may also disclose your personal information to the third parties concerned or their professional advisors. In the event of such a transaction, the personal information held by NCRA will be among the assets subject to the transaction.

Communications from NCRA

Choices you have

Except for transactional emails necessary to perform NCRA’s contractual obligations, where possible, we will not send you promotional information without your consent and you can withdraw consent at any time or update your preference by following the instructions included in each communication, by logging in your website account and utilize the communication preference setting, or by contacting the NCRA Member Services and Information Center (800-272-6262; 12355 Sunrise Valley Drive, Suite 610, Reston, VA 20191) to be removed from our postal, email, fax, or telephone contact lists.

In addition, you can request that information we receive from you not be used by us or shared with a third party. We may still maintain a record of your visits to our website, but we will not further solicit your business if you do not wish to hear from us. If you do not want to have any of your information provided to a third party (other than disclosures required by law, should that occasion arise), please notify the Member Services and Information Center.

Correcting incorrect information

You may request a copy of the information NCRA holds about you so you can correct or amend information that may be inaccurate or incomplete. If you discover that we have incorrect information about you, such as misspelled name, old mailing address, etc., please contact the Member Services and Information Center so we can make the appropriate correction. We may ask you to provide sufficient evidence of your identity for your own protection so we can ensure that information is being released to the correct person.

If something goes wrong

If you suspect or discover an abuse of your personal privacy that involves the NCRA.org website, please contact the NCRA Web Administrator or the Member Services and Information Center so that an appropriate investigation can take place.

Children’s information

The website is not intended for children under 13 years of age. NCRA does not knowingly collect personal information from children under 13 years of age. If NCRA discovers that a child under the age of 13 has provided us with personal data, we will delete the child’s personal data unless a parent or guardian provides verifiable consent to NCRA.

Our website has security measures in place to protect the loss, misuse, and alteration of the information under NCRA’s control. Notwithstanding the foregoing, when you submit information to NCRA through our website, you should be aware that your information is transmitted across the Internet and that no method of transmission over the Internet is 100% secure. Although we take reasonable security measures to protect your information when we receive it, you also need to ensure you take appropriate steps to protect your information.

International website access and cross-border data transfers

Our principal place of business is in the United States. If you are visiting the website from outside the United States, your information will be transferred to, stored, and processed in the United States where our servers are located and NCRA is based. In addition, information that NCRA collects may be stored and processed in and transferred between any of the countries in which NCRA operates to enable the use of the information in accordance with this Privacy Policy. You agree to such cross-border transfers of personal information.

Amendments and updates

NCRA will occasionally update this Privacy Policy. Any changes to our Privacy Policy will be posted here so that users will know what information we gather, how we might use that information, and whether we will disclose it to anyone.
